1. Introduction and Acceptance

Welcome to SBS Games, operated by Shahar Bar. By accessing or using this website (sbsgames.dev) or enrolling in any course offered through it, you ("Student" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use this site or enroll in any course.

These Terms constitute a legally binding agreement under Israeli law. Course enrollment is governed additionally by the Israeli Consumer Protection Law, 5741-1981, and its regulations.

3. Services

SBS Games offers live, instructor-led online courses in game development, programming, and related creative-technology skills. Course details, schedules, and pricing are published on individual course pages. Course content may include live video sessions, written materials, exercises, and access to a private student portal.

4. Enrollment and Payment

4.1 Enrollment. Enrollment is confirmed upon receipt of full payment (or an agreed payment schedule). A written enrollment confirmation will be sent to you.

4.2 Pricing. All prices are in New Israeli Shekels (₪) and are VAT-exempt (Shahar Bar is an עוסק פטור). The price shown is the price you pay.

4.3 Payment processing. Payments are processed through third-party payment providers. We do not store payment card details on our servers.

4.4 Receipts. A receipt (חשבונית) will be issued for each payment within 14 days.

5. Course Access and Delivery

5.1 Course sessions are conducted live via video conference. Session dates and times are published on the course page and communicated to enrolled students.

5.2 Recordings, if made available, are for enrolled students only and may not be shared externally.

5.3 We reserve the right to reschedule or substitute individual sessions. We will provide at least 48 hours advance notice when possible.

5.4 We reserve the right to cancel a course that does not reach minimum enrollment. In that event, a full refund is issued within 14 days.

6. Student Conduct

6.1 Students must treat instructors and fellow students with respect during all course sessions and communications.

6.2 Distributing, reproducing, or reselling course materials outside the enrolled cohort is prohibited.

6.3 We may remove a student whose conduct disrupts other participants. If removal is our decision and not caused by the student's breach, a proportional refund applies.

7. Intellectual Property

7.1 Our content. All course materials, slides, exercises, and recordings created by SBS Games remain our intellectual property. You may use them for your personal learning only.

7.2 Your work. Projects, code, and creative works you produce during the course remain yours. By participating, you grant us a non-exclusive, royalty-free right to display your work as an example of student outcomes (e.g., on our website or marketing materials). You may opt out at any time by notifying us in writing.

7.3 Third-party tools. Courses may involve third-party tools (e.g., Unity, Visual Studio Code). Use of those tools is subject to their respective license terms.

8. Disclaimer of Warranties

8.1 Courses are provided "as is." We do not guarantee any specific learning outcome, employment result, or business success.

8.2 The game-development industry is competitive. Results depend heavily on individual effort, prior experience, and market conditions. You assume responsibility for how you apply what you learn.

8.3 We do not warrant that the site will be uninterrupted or error-free.

9. Limitation of Liability

To the maximum extent permitted by Israeli law, our total liability for any claim arising from these Terms or from a course will not exceed the amount you paid for the specific course giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

10. Cancellation and Refunds

Your cancellation rights are governed by the Israeli Consumer Protection Law, 5741-1981. The full Refund and Cancellation Policy is published at /legal/refunds.

11. Privacy

We process your personal data in accordance with the Israeli Privacy Protection Law, 5741-1981, as amended by Amendment 13 (5784-2023). The full Privacy Policy is published at /legal/privacy.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Israel. Any dispute will be subject to the exclusive jurisdiction of the competent courts in the Tel Aviv-Yafo district, unless mandatory consumer-protection rules require otherwise.

13. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted with a revised "Last updated" date. Continued use of the site after changes constitutes acceptance of the updated Terms. We will notify enrolled students of material changes by email.

ברוכים הבאים ל-SBS Games, המופעל על ידי שחר בר. בכניסה לאתר (sbsgames.dev) או בהרשמה לקורס כלשהו המוצע דרכו, אתם ("סטודנט" או "משתמש") מסכימים לתנאי שימוש אלה ("התנאים"). אם אינכם מסכימים, אנא אל תשתמשו באתר ואל תירשמו לקורסים.

התנאים מהווים הסכם מחייב לפי דין ישראל. הרשמה לקורס כפופה גם לחוק הגנת הצרכן, תשמ"א-1981, ותקנותיו.

3. השירותים

SBS Games מציע קורסים חיים ומונחי-מדריך בתחום פיתוח משחקים, תכנות ומיומנויות יצירה טכנולוגית קשורות. פרטי הקורסים, מועדים ומחירים מפורסמים בדפי הקורס הרלוונטיים. תכני הקורסים עשויים לכלול מפגשי וידאו חיים, חומרי לימוד כתובים, תרגילים וגישה לפורטל סטודנטים פרטי.

4. הרשמה ותשלום

4.1 הרשמה. ההרשמה מאושרת עם קבלת התשלום המלא (או לפי לוח תשלומים מוסכם). ישלח לכם אישור הרשמה בכתב.

4.2 תמחור. כל המחירים בשקלים חדשים (₪) ופטורים ממע"מ (שחר בר הוא עוסק פטור). המחיר המוצג הוא המחיר שתשלמו.

4.3 עיבוד תשלומים. התשלומים מעובדים דרך ספקי תשלומים של צד שלישי. אנחנו לא שומרים פרטי כרטיס אשראי בשרתינו.

4.4 קבלות. חשבונית תישלח עבור כל תשלום תוך 14 יום.

5. גישה לקורס ואספקה

5.1 מפגשי הקורס מתקיימים בשידור חי דרך ועידת וידאו. תאריכים ושעות מפורסמים בדף הקורס ונמסרים לסטודנטים הרשומים.

5.2 הקלטות, אם יוצעו, מיועדות לסטודנטים הרשומים בלבד ואסור לשתפן מחוץ לקבוצה.

5.3 אנחנו שומרים לעצמנו את הזכות לשנות מועד מפגש בודד או להחליף מדריך; ניתן הודעה מוקדמת של לפחות 48 שעות ככל האפשר.

5.4 אנחנו שומרים לעצמנו את הזכות לבטל קורס שלא הגיע למינימום נרשמים. במקרה כזה, יוחזר תשלום מלא תוך 14 יום.

6. התנהגות הסטודנט

6.1 הסטודנטים חייבים לנהוג בכבוד כלפי המדריכים והסטודנטים האחרים בכל מפגשי הקורס והתקשורת.

6.2 אסור להפיץ, לשכפל או למכור חומרי קורס מחוץ לכיתה הרשומה.

6.3 אנחנו רשאים להסיר סטודנט שהתנהגותו מפריעה למשתתפים אחרים. אם ההסרה היא יוזמתנו ואינה נובעת מהפרת הסטודנט, חל החזר יחסי.

7. קניין רוחני

7.1 התכנים שלנו. כל חומרי הקורס, המצגות, התרגילים וההקלטות שיצרנו הם קניינו הרוחני של SBS Games. אתם רשאים להשתמש בהם ללמידה אישית בלבד.

7.2 עבודותיכם. פרויקטים, קוד ויצירות שתיצרו במהלך הקורס נשארים שלכם. בהשתתפות בקורס, אתם מעניקים לנו רישיון לא-בלעדי וחינמי להציג את עבודתכם כדוגמה לתוצרי סטודנטים (למשל, באתרנו או בחומרי שיווק). ניתן לסרב לכך בכל עת בהודעה בכתב.

7.3 כלים של צד שלישי. הקורסים עשויים לכלול כלים של צד שלישי (כגון Unity, Visual Studio Code). השימוש בכלים אלה כפוף לתנאי הרישיון שלהם.

8. הגבלת אחריות

8.1 הקורסים מוצעים "כמות שהם". אנחנו לא מבטיחים תוצאות למידה ספציפיות, מציאת עבודה או הצלחה עסקית.

8.2 תעשיית פיתוח המשחקים תחרותית מאוד, והתוצאות תלויות במאמץ האישי, ניסיון קודם ותנאי השוק. האחריות על אופן יישום מה שלמדתם היא שלכם.

8.3 אנחנו לא מתחייבים שהאתר יפעל ללא הפרעות או שגיאות.

9. הגבלת אחריות נזיקית

במידה המרבית המותרת לפי הדין הישראלי, אחריותנו הכוללת בגין כל תביעה הנובעת מתנאים אלה או מקורס לא תעלה על הסכום ששילמתם עבור הקורס הספציפי. איננו אחראים לנזקים עקיפים, מקריים או תוצאתיים.

10. ביטול והחזרים

זכויות הביטול שלכם כפופות לחוק הגנת הצרכן, תשמ"א-1981. המדיניות המלאה מפורסמת ב/legal/refunds.

11. פרטיות

אנחנו מעבדים את המידע האישי שלכם בהתאם לחוק הגנת הפרטיות, תשמ"א-1981, כפי שתוקן בתיקון 13 (תשפ"ד-2023). מדיניות הפרטיות המלאה מפורסמת ב/legal/privacy.

12. דין חל וסמכות שיפוט

תנאים אלה כפופים לדיני מדינת ישראל. כל סכסוך יהיה נתון לסמכות הבלעדית של בתי המשפט המוסמכים במחוז תל אביב-יפו, אלא אם כללי הגנת הצרכן המחייבים מחייבים אחרת.

13. שינויים בתנאים

אנחנו רשאים לעדכן תנאים אלה מעת לעת. שינויים נכנסים לתוקף עם פרסומם עם תאריך "עדכון אחרון" מתוקן. המשך השימוש באתר לאחר שינויים מהווה הסכמה לתנאים המעודכנים. נודיע לסטודנטים הרשומים על שינויים מהותיים בדוא"ל.
